Requirements in job ads continue to get tougher all the time. In the
good ol' days you could get hired if you were a good match for the job.
In recent years you had to have a perfect match of skills with the
exact amount of experience listed. Now it's even tougher - you have to
have the correct national origin and visa to get the job.
The Elixir job ad below requires applicants to be of Indian origin
only. That means that if you are of Indian ancestry, but born in the
US, you need not apply. Indians that are naturalized citizens wouldn't
qualify either. Simply put, no American citizen can get this job
regardless of national origin or ancestry. Elixir appears to only want
programmers that were born in India that possess a current H-1B or
Green Card visa.
Scott Ray contacted the EEOC about this job ad. He has some interesting
commentary that I include below.
Saronne Balian took a different approach to that Oracle ad for H-1Bs
only. She sent an email complaint to the Dept. of Justice OSC.
Saronne's complaint to the DOJ/OSC is a good choice, but her results
were even worse than Scott's. She got no response.
We can learn a few things from Scott and Saronne about how to file
complaints to the EEOC or the DOJ. Here is a summary if any of you want
to file complaints:
1 - (THIS IS THE MOST IMPORTANT) You must apply for the job before the
EEOC/DOJ will take action. Your best bet would be to send a resume to
the employer by certified mail so that you can prove that you applied.
At a minimum send a resume that's dated, and include that in your
complaint.
2 - Email and phone calls to the EEOC or DOJ will probably not
accomplish much but they are still worth a try if you don't want to
spend the time to send a letter. At least they will log your complaint
so that they know that American workers are noticing the
discrimination. Phone calls are probably more effective than emails,
especially if you want to vent some anger!
3 - I recommend that your complaint to the EEOC or DOJ is sent using
certified mail with a return receipt. That will force them to respond
because they can't deny they received the complaint.
Since I still haven't seen the government do anything about this
blatant discrimination against American citizens, I can't give better
advice on what to do. Perhaps some day one of you will succeed, and if
you do, let me know how you did it. Until then, all I can say is to
keep trying, but don't expect any miracles from our corporatized
government.
Elixir is an Indian based company so they probably don't understand
that discrimination may be acceptable in India, but it's not to be

I called the EEOC concerning this posting from Elixir. They told me
that someone had to apply before they would take action. The EEOC told
me that the employer is clearly violating US law. I encourage anyone to
apply and then complain to the EEOC concerning this very blatant form
of discrimination

Rob,
A while back when you sent this job description for H-1B, I said our
government will do nothing about it and you said that you knew that but
when you say things like that people accuse you of being too negative.
Well, I wanted to prove our point; so I sent the e-mail below to the
Justice Department. They never bothered to respond - not even an
acknowledgement reply. This is not my first and only experience with
our government agencies.
Whenever anyone accuses you of being too negative, tell them about this
and many more like it.

This company has an urgent need for an Oracle programmer, but only if
you are an H-1 visa holder.
Isn't it wonderful to discriminate against US citizens and have
millions of US citizens with advanced degrees and many years of
experience be unemployed and homeless in our own country, USA, and have
our government continue to encourage and partake in such
discriminations?
