Job Ad for TN Visa Holders Only

Employers must be getting too many applications from American citizens, so some of them are putting the fact that you must be a visa holder right in the job title!

The first ad requires applicants to have a TN visa from Canada, Mexico, or Chile. The employer must not realize that the TN (or Trade NAFTA) visa will only work for Canadians and Mexicans. If they want to hire someone from Chile their options would be to use L-1 or H-1B1 visas. The H-1B1 was created in the Chile/Singapore FTA which I often call SHAFTA.

It's rather odd that they specified a small country like Chile unless they already have somebody in mind to hire. I have often suspected that a growing number of South Americans are sneaking into Mexico so that they can use a TN visa to cross our border. The TN visa acts like a backdoor into the U.S. and since it's now unlimited from Mexico it will be very tempting to use. All the Chilean would need to do is pay for a fake Mexican ID card and then show up at the U.S. border with this job ad and then presto - he or she will get a TN visa to work as a programmer in the Estados Unidos. Probably the toughest question the Chilean would be asked is if he spoke Spanish.

I'll soon be doing another newsletter on CAFTA, because if it passes you can expect a lot more companies to shun American citizens for cheap foreign labor. The signatory nations will have a very good case in an international tribunal to demand a TN type of visa. Countries like Nicaragua and El Salvador will argue that they should be granted the same privileges as the average Mexican high-tech worker or manager, and why wouldn't the tribunal agree?

The second ad wants an H-1B transferee. By putting that requirement in the job title they make it very clear that Americans aren't welcome. The bodyshop that ran the ad wants to transfer an H-1B that is already working for another company in the U.S. so they don't have to pay the cost of getting a new visa. What a bunch of cheapskates!
