The news brief titled "Anti-Immigrationists Outmaneuvered" was sent out today in an ILW newsletter. As you will see by reading it, the immigration lawyers are quite elated over Hagel's strategy.
Combined, the four immigration bills introduced by Hagel are similar to the other two major guest-worker bills in the Senate. What Hagel has done is to split the legislation up into smaller chunks so that they are easier to pass through Congress, and more important to thwart those of us who want to stop massive expansions of guest-workers and amnesty.
One common denominator Hagel's bill has with those by McCain/Kennedy, Kyl/Cornyn, and in the House by Rep. Tancredo is that they all use a large internet database called "America's Job Bank" to control the guest-worker system. It's a socialistic concept that requires the government to control the entire labor market of the U.S. and to adjudicate disputes between employers and citizens who compete for jobs with foreign guest-workers.
Hagel's bill leaves the H-1B limit at 65,000 but gives unlimited exemptions for foreign students who graduate from a U.S. university, and they have unlimited exemptions from the Green Card limit that's set at 140,000. Guest-worker visas for "low-skilled" workers are unlimited.
Of the four bills, S. 1918 probably would be of the most interest to the readers of this newsletter. It can be viewed at Thomas.gov. It's subtitle explains its intent quite clearly: "To amend the Immigration and Nationality Act to address the demand for foreign workers."

Anti-Immigrationists Outmaneuvered
On Tuesday, October 25, 2005, Sen. Hagel introduced comprehensive immigration reform legislation consisting of four bills comprised of border enforcement, interior enforcement, a temporary guestworker program, and legalization.

The next day Sen. McCain, Sen. Cornyn, and Senate Majority Leader Frist jointly agreed that "comprehensive immigration reform was the way to go (see 10/27/05 ID comment). The sudden unity of the three Senators formerly opposed on the correct approach to immigration reform is the result of Sen. Hagel's brilliant political maneuver in introducing four separate immigration reform bills, thus making immigration reform comprehensive and not comprehensive at the same time.
By leaving it up to Congress to move forward on any or all of the four bills in any sequence, Sen. Hagel has outmaneuvered the anti-immigrationists who have long cried for tough enforcement (employer and border). The momentum created by the anti-immigrationists for immigration reform will now be used against them by Congress since guestworkers and legalization will be the price exacted for border and employer enforcement.
