In my previous newsletter titled "Argentine Playmate wants H-1B visa" I
described how the bombshell that goes by the name Dorismar came to the U.S.
as an illegal alien, was deported, and then hired a lawyer to obtain an
H-1B visa so that she could return to the U.S.
On February 9th, the Immigration Lawyer's Website (ILW.com) newsletter
confirmed that Dorismar was attempting to get an H-1B visa. Today they sent
out a correction that Dorismar is trying to get an "O" visa, not an H-1B.
"O" visas are to be given only to the truly outstanding scientific geniuses
in the world. Typically most applicants are denied unless they are on the
level of Nobel laureates. If Dorismar succeeds in her quest for an "O" visa
it will make a farce of the visa, and it will be an insult to whomever has
been granted one.
Dorismar is indeed a Latina singer and voluptuous soft-porn pin-up girl,
but she is in no way exceptional enough to qualify for an "O" visa. I base
my opinion on her official website.

After clicking "English" you will be treated to one of her songs. By moving
your cursor to a corner of the picture box you can click to leaf through
her online scrap booklet. It contains pictures (highly recommended), some
of her writings, and two more songs with videos included (even more highly
recommended).
Let's look at Dorismar's major assets that the lawyer uses to claim that
she is qualified for an "O" visa.
ASSETT #1: Dorismar's lawyer claims that she has extraordinary abilities
to, "show what men like to see in magazines like 'Playboy'".
Without question most men will enjoy looking at her posing in Playboy (I
don't have that issue but sure want to find one!). Speaking from the male
point of view, I must say that every woman in Playboy has the same ability,
and as far as her looks she is probably slightly above average for that
magazine. I give her an above average rating only because I'm biased
towards Latina hotties. Some guys might prefer the blondes, African
Americans, Asians, or other types of women on display in Playboy - it's
mostly a matter of personal preference. Nowhere in the "O" visa description
does it say that all women who are in Playboy or any other type of
pornographic magazine can qualify for an "O" visa.
ASSETT #2: Dorismar's lawyer claims that Dorismar should get a visa because
she has an exceptional butt.
Hey, I'm not kidding, he really said that! Read my last newsletter if you
don't believe me. The lawyer actually cites this as the #1 reason for
Dorismar to get a visa. The lawyer mentioned that Dorismar made it on Mira
Magazine's list of the Top 25 'Rears' in the entertainment business. I
decided to check out Mira magazine but they don't seem to have their own
website. Judging by the magazine cover it's a rag sort of like a low budget

"O" visas require membership in associations in the field which require
outstanding achievements as judged by recognized international experts. I
hardly think the Mira survey qualifies as an international expert on butts.
Oxygen magazine rated Jennifer Lopez as having the best butt. Lopez's
shapely cheeks edged out Beyonce and Angelina Jolie, so Dorismar didn't
even make it to the top three even when competing with other Latinas.
Judging butts is a lot of fun but it's also very subjective so it's no
surprise that American magazines don't rate Dorismar as an owner of one of
the world's greatest rear ends. Making Mira's Top 25 list of cute derrieres
doesn't qualify in the "O" category for recognition. In my opinion Dorismar
has a world class butt, but of course this newsletter isn't exactly
designed to evaluate such things.
ASSETT #3: Dorismar is an exceptional actor.
Let's have a reality check here. Dorismar starred in "Latinas gone Crazy"
which is about a bunch of drunk college girls, I haven't seen this movie,
but there is no way that being an actor in a grade B movie qualifies her as
an outstanding actor. "O" visas require a receipt of nationally or
internationally recognized prizes or awards for excellence in the field of
endeavor. Dorismar cannot make that claim until she wins an Academy award.
ASSETT #4: Dorismar's singing.
Even a great opera singer like Pavarotti would fail to qualify for an "O"
visa because the requirments say that their services consist of a specific
business project that requires an extraordinary executive, manager, or
highly technical person due to the complexity of the project.
As for singing talent, Dorismar is rather average even as compared to most
Latina pop music singers. Technically speaking there is no reason she can't
sing and record in Argentina so allowing her into the USA doesn't serve in
the national interests. It goes without saying that Dorimsar isn't even in
the same class as Pavarotti, so she immediately fails this test.
ASSETT #5: Dorismar can dance.
Judge for yourselves by watching the videos online, but in my opinion her
dancing is no better than the average go-go dancer at a strip joint.
"O" visas require that Dorismar provide evidence that she commands a high
salary or other high remuneration for services. One thing for sure,
Dorismar probably doesn't come cheap! She performed at Disneyland,
Broadway, and John Kerry's Democratic National Convention so you can bet
that she probably got paid plenty for her performances. Considering all of
this she would fail the requirement that "O" visa holders meet specific
business projects that requires an extraordinary executive, manager, or
highly technical person due to the complexity of the project. There was
nothing complex about the way she jiggled onstage in that short white
skirt!
ASSETT #6: Intangibles
"O" visas require that the alien has published material in professional or
major trade publications or newspapers. One thing for sure, Dorismar isn't
going to get very far on her writing abilities. This is what she has to say
about her recipe for romance on her website: "I prefer the open air for a
special, motivating and romantic moment."
CONCLUSION: Dorismar fails on all accounts to qualify for an "O" visa. She
would be better off applying for an H-1B since those visas are usually used
for mediocre talents. Salary won't be an issue because my guess is that
whoever hires her will definitely pay more than the prevailing wage level
for Playboy bunnies.

Erratum
Immigration Daily incorrectly stated in our comment (02/09/06 ID) that a
former Playmate model was petitioning for an H-1B as a fashion model of
"distinguished merit and ability". We received several letters to the
Editor, including one from her immigration attorney, correcting our error
(scroll below for the letters). She in fact petitioned and was approved for
an EB-1 visa and is applying for a waiver which would permit her to
re-enter in the O-1 category. We thank our readers for alerting us to the
error.
While in this particular case, the non-immigrant visa at issue is an O-1,
it is in fact true like our 2/9/06 comment stated that fashion models
qualify under a different standard than other H-1B beneficiaries, another
one of those anomalies that make immigration law so complex.

H1B For Playboy Model
The Miami Herald reports that a former Playmate model seeks re-entry to the
US after being removed from the US for overstaying her visa. Her
immigration attorney is reportedly petitioning to obtain an H-1B visa for
her under the provision in the statute at 101(a)(H)(i)(b) for fashion
models of "distinguished merit and
ability". While all other occupations require a bachelor's degree or
equivalent experience under the statutory provisions at 214(i) (1) and (2)
a fashion model does not need a bachelor's degree or equivalent experience.
Why not have similiar provisions for occupations other than fashion model
for those possessing
"distinguished merit and ability" regardless of the attainment of a
bachelor's degree or equivalent experience. For the full Miami Herald
